When parties first separate, there are many decisions to be made. One of those decisions will be the method by which the issues between you and your spouse are to be resolved.
Cohabitation and Prenuptial Agreements
Increasingly, couples entering into a marriage or marriage like (i.e. “commonlaw”) relationship are addressing the issues that might arise from a separation at the outset of the relationship or during the course of the relationship.
Negotiated Settlement
Ideally, parties to a separation will be able to resolve their differences by way of a negotiated settlement.
Court Proceedings
Sometimes it is necessary to involve the Courts in the resolution of the issues between the parties. Generally, this is where an element of urgency exists or where settlement of the issues is not likely.
